ป.ป.ช.รับสอบคดี พล.ต.อ.สุรเชษฐ์ หักพาล เกี่ยวข้องกับเครือข่ายเว็บพนัน เมื่อวันที่ 4 มี.ค. 2567 รับพิจารณาคดีที่ พล.ต.อ.สุรเชษฐ์ หักพาล รองผู้บัญชาการตำรวจแห่งชาติ(รองผบ.ตร.) กับพวก รวม 5 คน ถูกกล่าวหา เรียกรับเงินซึ่งพัวพันกับเว็บพนันออนไลน์เครือข่ายมินนี่ และร่วมกันฟอกเงิน นายนิวัติไชย เกษมมงคล เลขาธิการ ป.ป.ช. เปิดเผยว่า คณะกรรมการ ป.ป.ช.มีมติเห็นว่า เป็นการกล่าวหาผู้ดำรงตำแหน่งสูงกว่าระดับผู้อำนวยการ และกล่าวหาว่า เป็นการกระทำความผิดร้ายแรง ซึ่งอยู่ในอำนาจของ ป.ป.ช. คณะกรรมการจึงมีมติให้รับเรื่องนี้ไว้พิจารณาดำเนินการตรวจสอบและไต่สวนเอง รวมทั้งพิจารณาว่า ในสำนวนแรกที่กล่าวหา พ.ต.อ.ภาคภูมิ พิศมัย กับพวกนั้น เป็นความผิดที่เกี่ยวเนื่องกัน จึงมีมติให้ขอสำนวนคืนมาทั้งหมด เพื่อมาพิจารณาในคราวเดียวกัน
ส่วนกรอบระยะเวลาการทำงานนั้น ต้องดูข้อมูลที่พนักงานสอบสวนจะส่งมา
เพราะส่งมายังไม่ครบ หากส่งมาครบก็สามารถสั่งไต่สวนได้เลย
ไม่ต้องตรวจสอบข้อเท็จจริงเพิ่มเติม ดังนั้น
ต้องดูสำนวนตำรวจก่อน หากครบแล้วก็ไต่สวนได้
ซึ่งการตั้งไต่สวนอาจเป็นคณะกรรมการป.ป.ช.ทั้งคณะเป็นองค์คณะ
การที่ป.ป.ช.รับเรื่องนี้ไว้พิจารณาเองนั้น
เป็นไปตามบทบัญญัติรัฐธรรมนูญ มาตรา 234 อยู่แล้ว ดังนั้นเรื่องร้ายแรง มอบไม่ได้
ทั้งนี้ กรณีเจ้าหน้าที่ของรัฐหากเป็นระดับล่างอาจจะมอบได้
แต่เจ้าหน้าที่รัฐระดับสูงมอบไม่ได้ ทั้งนี้กรรมการป.ป.ช.ปัจจุบันเหลืออยู่ 5 คน

มีผู้ต้องหา 61 คน ทั้งตำรวจและประชาชน มูลค่าความเสียหายกว่า 300 ล้านบาท
ซึ่งเป็นคดีหลัก

ที่มีรายชื่อ พล.ต.อ.สุรเชษฐ์ ต่อศาลอาญาของพนักงานสอบสวน ศาลมีคำสั่งยกคำร้อง
คือไม่ออกหมายจับ และศาลได้มีดุลพินิจว่าไม่มีพยานหลักฐาน
เพียงพอที่จะออกหมายจับตามคำร้อง แต่กลับมีการออกข่าวทำนองว่าศาลออกหมายเรียก
หมายจับ และจากการตรวจสอบพบว่าศาลไม่ได้ออกหมายจับชี้อำอาจอยู่กับ
ป.ป.ช.-พนักงานสอบสวนเสี่ยง ม.157

เมื่อมีการยกคำร้องดังกล่าว จึงมาดูว่าในส่วนขั้นตอนที่จะทำต่อไป
หากพนักงานสอบสวนจะดำเนินการต่อ พบว่าการที่พนักงานสอบ สวนยังดำเนินการอยู่
ถือว่าไม่ถูกต้อง เพราะข้อเท็จจริงที่กล่าวหา พล.ต.อ.สุรเชษฐ์ มีการส่งเรื่องไป
ป.ป.ช.และมีมติรับเรื่อง ดังนั้นคนที่จะสอบสวนว่า พล.ต.อ.สุรเชษฐ์
จะมีความผิดหรือไม่อำนาจจึงอยู่ที่ ป.ป.ช. ตาม
พ.ร.บ.ประกอบรัฐธรรมนูญว่าด้วยการป้องกันทุจริต มาตรา 30 ประกอบมาตรา 28 นอกจากนี้
ยังตั้งข้อสังเกตว่า การออกหมายจับในช่วงนี้ พล.ต.อ.สุรเชษฐ์
และทีมทนายเข้าใจเป็นอย่างอื่นไม่ได้เลยว่าเป็นการดิสเครดิต
เพราะท่านเป็นรองผบ.ตร.อาวุโสอันดับ 1 เป็นแคนดิเดตที่จะได้รับการพิจารณาแต่งตั้ง
การออกหมายจับในช่วงนี้ ทำให้เสียหายทั้งชื่อเสียง
และมีผลเกี่ยวกับการการพิจารณาแต่งตั้ง

ส่วนพนักงานสอบสวนจะไปให้ข้อมูลศาล หรือสื่อมวลชนอย่างไรนั้น ต้องรับผิดชอบเอง
นอกจากนี้ พล.ต.อ.สุรเชษฐ์
มอบหมายให้ทีมทนายความเก็บพยานหลักฐานทุกอย่างที่เผยแพร่ต่อสื่อมวลชน
เพื่อใช้ปกป้องสิทธิ และยืนยันว่าข้อกล่าวหา พฤติการณ์
และเส้นทางการเงินที่พาดพิงมาถึงนั้น ไม่เป็นความจริง
โดยยืนยันว่าไม่เคยมีเส้นทางการเงินใดเกี่ยวพันกับเว็บพนันออนไลน์
ส่วนเงินที่ส่งมอบให้ พ.ต.ท.คริษฐ์ นำไปใช้จ่ายเรื่องต่าง ๆ เป็นเงินของ
พล.ต.อ.สุรเชษฐ์ ไม่ใช่เงินเว็บพนัน
